His Excellency agrees with the view that we should not recognise any right on the part of the Turks to demand extradition of persons for offences committed before the coming into force of the Treaty i.e. 18th, July, 1926. This applies equally to persons taking refuge in 'Iraq after that date if their offences were committed before it. That does not necessarily mean that 'Iraq should always refuse to extradite such persons, but their extradition would be an act of grace on the part of the 'Iraq Government. If the criminal had taken refuse in the opposite zone before 18th. July, 1926, and raids across the frontier after that date and again takes refuge in the opposite zone, his extraditio be could justifiably demanded under Article 9. the criminal is in the hands of his own Government authorities there is nothing to prevent the latter from proceeding against him for offences committed by him before July 18.
