In applying for his return we should be relying on Part I rather than Part II of the Fugitive Offenders Act but in view of the comments of the Indian Chief Justice on Part II of the Act it seems unlikely that the Indian Government would agree to our request. Nevertheless I shall be grateful if you will let us know in due course whether you think that any useful purpose would be served by a formal approach to the Indian Government. 2. Although the Indian Courts may now have ruled that the Fugitive Offenders Act does not apply in India, it is worthy of note that in April 1953 the Indian Government were proposing to invoke its provisions to secure the extradition of an Indian national living in Kuwait, I am enclosing a copy of the relevant letter from the Ministry of External Affairs New Delhi to the Political Resident. In the event, the Indian Government did not follow up their initial request.
